Directive 2006/54/EC of the European Parliament and of the Council on the implementation of the principle of equal opportunities and equal treatment of men and women in matters of employment and occupation has obliged the Polish lawmakers to amend the Polish Labour Code. As a consequence, the universal (i.e. applicable to all women) ban on hiring women for strenuous or harmful-to-human-health jobs has been abolished. The new regulation which came into force on 1 May 2017 lists strenuous, dangerous or harmful jobs which is applicable exclusively to pregnant and breastfeeding women.

As the Labour Code requires in-house work rules to list the tasks which women cannot perform, this new law should prompt you to review your existing work rules and amend them accordingly. Failure to take any actions may lead to liability for an offence or a fine of up to PLN 30,000.
