New rules on mandatory use of Ukrainian language on websites and in computer programs in Ukraine

On July 16, 2022, the provisions of Law of Ukraine "On Ensuring the Functioning of Ukrainian Language as a State Language" No 2704-VIII of April 25, 2019 will become effective. According to these provisions, the use of Ukrainian language, which is the state language of Ukraine, will be mandatory in computer programs and on websites, including the websites of foreign companies selling goods and services in Ukraine.

According to the new rules contained in paragraphs 2, 6 of Article 27 of the above-mentioned Law, a computer program with user interface installed on goods which are sold in Ukraine shall have a user interface in Ukrainian language.The user interface in Ukrainian language shall contain at least the same volume of information as the interface in other languages. The goods that do not comply with the user interface language requirement are considered to be faulty goods. The sale of faulty goods is a violation of consumers' rights which leads to penalties and may even result in restriction of company's business operations.

The internet presence (website, social network site) of companies registered in Ukraine and selling goods and services in Ukraine shall be in Ukrainian language. The version of the internet presence in Ukrainian language shall contain at least the same volume of information as the versions in other languages, and the Ukrainian version shall be loaded by default for the users in Ukraine.

The websites of foreign companies selling goods and services in Ukraine and having subsidiaries, branches or representative offices in Ukraine shall also have a Ukrainian language version. The scope and contents of the Ukrainian version shall be sufficient for clear navigation and shall disclose the purposes of website owner's activities. The Ukrainian language version of the website shall be loaded by default for users in Ukraine.

The failure to comply with the above requirements is subject to administrative liability in the form of a warning or a fine ranging from UAH 3,400 to UAH 5,100, and for repeated violation - from UAH 8,500 up to UAH 11,900 (section 3 of Article 18852 of the Code of Administrative Offences of Ukraine, which also becomes effective on July 16, 2022).
